Three new bills introduced by Home Minister Amit Shah have created a political stir. According to these bills, if a minister, chief minister or prime minister remains in jail for more than 30 days on charges of a serious crime, he will lose his office. The opposition termed it “unconstitutional” and said that the law goes against the principle of “impunity before conviction”. She got bail after being in jail for 21 days. Jitendra Tomar (AAP): In 2015, as the Law Minister of Delhi, she was arrested on charges of fake degree. Spent one and a half months in jail. Satyendra Jain (AAP): In 2022, Delhi Health Minister, arrested by the ED under the PMLA. Spent 18 months in jail. Manish Sisodia (AAP): In 2023, Delhi Deputy Chief Minister, arrested by the ED and CBI in a liquor policy case. Spent 17 months in jail. Arvind Kejriwal (AAP): In 2024, Delhi Chief Minister, arrested by the ED and CBI in a liquor case. Spent 5 months in jail. V. Senthil Balaji (DMK): In 2023, Tamil Nadu minister arrested by ED in bribery case. Spent 15 months in jail. Nawab Malik (NCP): In 2022, Maharashtra minister arrested by ED in money laundering case. Spent 18 months in jail. Madan Mitra (TMC): In 2014, Bengal minister arrested by ED and CBI in Saradha scam. Spent 20 months in jail. Jyoti Priya Mallick (TMC): In 2023, Bengal Minister arrested by ED in ration scam. Spent 14 months in jail. Only one BJP minister, Rakesh Sachan, was convicted in 2022, but he was not arrested and is now on bail. Opposition alleges The opposition says the ED and CBI are being used only against non-BJP ministers. According to The Wire, 121 opposition leaders have been investigated since 2014, while only 4 BJP leaders have been prosecuted. Mamata Banerjee called it a "super emergency", while Priyanka Gandhi said the law is a conspiracy to weaken the opposition.
